TERMS AND CONDITIONS

AIO Fitness App & All Partnerships Applications

Dues:

Members agree to promptly pay all the monthly charges and dues after being accepted for membership. The first month’s dues or pro-ration thereof will be due upon signing the contract. Dues will be billed on the first of the month and are due and payable with or without a statement. If delinquent more than 60 days, AIO may cancel the Member’s membership and begin collection proceedings to satisfy Member’s total membership obligations under this Agreement. A 30-day notice will be given whenever there will be an increase in dues to maintain the quality of The App, if so desired, Member may terminate his or her membership during such 30-day period.

Cancellations/Assignment:

Members may cancel any agreement with a written notice sent to ( Email: Support@aiofitness.com) PLEASE allow 14 days for your termination to take place. We will do our best to stop all transactions from taking place. Though, we are not responsible for any transactions that take place during that time period. We do not refund membership dues unless; an obvious error has occurred after 14 days.

Term:

After Member has completed the term of his or her original membership/program (as set forth on the application page or medical advisor/program), Member’s membership will automatically renew as month to month. Unless the member provides AIO with written notice of cancellation at least  14 days prior to the renewal date. Memberships can be frozen for up to 30 days in each 12-month period. 

Additional Fees:

Member will be subject to the following additional fees:

- There will be a $10 late fee if dues are paid after the 5th of the month or if the EFT is declined. 

Rules and Regulations:

Member (s) agree to abide by the rules and regulations that may be promulgated from time to time by The Apps. Member agrees that violation of such rules and regulations may cause Member’s membership to be immediately terminated in the sole discretion of AIO.

No Waiver:

AIO does not waive its right to have future payments made when due if, AIO accepts a late or partial payment or delays in the enforcement of its rights on any occasion.

Default:

If Member in any way defaults in the performance of his or her obligations under this Agreement, then AIO may immediately demand and be entitled to payment of all unpaid installments. If Member’s failure to pay any one or more of the payments due under this Agreement results in AIO retaining an attorney for collection of the payments due hereunder, Member will be responsible for the payment of court costs and reasonable attorney fees.

Liability Waiver:

It is agreed that all use of AIO Fitness applications and its Partners Applications will be undertaken by Member at his or her own risk. AIO expressly disclaims all warranties, express or implied. It is further agreed that AIO, its owners, members, managers, employees, representatives, and agents will not be liable for any damages - direct, consequential, exemplary, special, punitive, or otherwise - arising from personal injuries sustained by Member while using the App. Members accept full responsibility of any injuries or damages that may occur to the Member while participating in any exercise video/class. 

Member’s Physical condition:

Members knowingly take part in any and all AIO or Partnership activites, knowing their own limitations and disabilities can limit their involvement pending the exercise or situation taking place. Members agree to take full responsibility for all injuries that can occur while using the app and taking part in videos that do not have any coaching taking place. Member is responsible for informing all coaches beforehand of limitations if they are going to participate in a live training program. Failure to do so releases the coach of any responsibilities to your limitations and possible injuries. 

Application Unavailability:

AIO & Partners reserve the right, and without prior notice to Members, to temporarily close The App or a portion thereof, for remodeling, improvements or repairs. AIO will do its best to hold up dates and changes to a 48 period and on the least utilized periods.  AIO reserves the right to permanently close Apps, and in such event, the Member’s membership will be terminated Immediately.

Use of Applications:

Members agree to be subject to the control and guidance of all application demonstrators or coaches/staff.  Member agrees to conduct himself or herself in a quiet, well-mannered fashion while on live exercise videos or in group training events. In the event of an accident, Member agrees to be examined at Member’s sole expense by a licensed physician. 

Indemnification:

Member agrees to indemnify and hold AIO Applications harmless for any and all liability, loss, claims, expenses (including attorneys fees), and other damages (collectively, "Damages") resulting from a breach of this Agreement or caused by member in connection with his or her use of The App or the equipment therein, including property damage and personal injury or death.

General:

The provisions of this Agreement are severable. If any provision of this Agreement is declared to be void, not valid or unenforceable, it is the intention of the parties to this Agreement that the remainder of this Agreement remain valid and enforceable. This Agreement and the rules and regulations referenced herein represent the entire agreement between AIO, its partnerships and all Members. AIO will have all rights and remedies provided by law and the remedies provided in this Agreement are cumulative. The laws of the State of govern this Agreement. Thus, All member must be 18 years old or older, unless approved by their guardian. Thank You!
